IWFF Court Case Regarding CCJ – September 2022 Update

Firstly, I want to say thank you to all of the players, managers and officials who have given us support and confidence, to pursue justice regarding the IWFF and what has happened to me, our company and others within the Walking Football community.

A reminder of what the IWFF is:

IWFF is the company responsible for “the running and promotion of The International Walking Football Federation” (from the IWFF Objects Clause filed with Companies House)

As you may know, Terry Rice – in his capacity as the sole Director of IWFF – had to attend court recently with the IWFF business records, including those which need to be kept for a minimum of 6 years under UK Law.

The reason I have been quiet following this court hearing, is that I believed the courts made a mistake, having treated Mr Rice as an individual Judgement Debtor and not as an Officer of the Judgment Debtor Company.

I have, therefore, proceeded with an official complaint to the court regarding this error.

Today (2nd September 2022), I have received a reply regarding my complaint. The takeaway from this can be summed up in two important snippets from their apologetic response, as follows;

“Thank you for your complaint received on 18TH August 2022. I am sorry you have had cause to complain about the service you have received from the Court. It is my role in accordance with HMCTS complaints procedure to investigate your complaint.

I have investigated this matter and there has an administrative error by the Court on this occasion regarding your application and the N39 hearing. We have referred the file to a District Judge and the Judge gave directions for another N39 Order to attend Court for questioning hearing to be issued addressed to Mr Rice as an Officer of the Judgment debtor company not as the Judgment debtor so there is no requirement for a fresh application to be made. The N39 is to be listed before an officer of the Court and the new hearing date will be sent out shortly.

I apologise for the administrative error that occurred in dealing with your application and any inconvenience or problems this has caused you. I hope that this is a satisfactory conclusion to your complaint.” 

All requested information regarding IWFF LTD accounts, assets and intellectual property rights, will now definitely have to be produced without fail, this second time around. This is a very serious court request and failure to attend on behalf of the IWFF, could result in contempt of court and a prison sentence.

Unless, of course, IWFF choses to settle this outstanding CCJ in full, prior to the new court attendance date (TBC)
